Близо 3 часа днес съдийската колегия обсъждаше дали да назначи двама заместник-председатели на Софийския градски съд (СГС). Председателят на съда Калоян Топалов бе предложил съдиите от Софийския районен съд (СРС) Биляна Балинова и Радостина Данаилова да ръководят съответно Гражданското и Търговското отделение на съда. Точката вече бе отлагана с мотив, че е необходимо Топалов да изложи допълнителни аргументи защо се налага заместник-председателите на СГС да бъдат външни за съда, а днес председателят на най-големия окръжен съд в страната се яви лично пред кадровиците, за да обясни решението си да предложи съдии от СРС да станат част от ръководния екип.
Топалов направи дълго изложение, от което стана ясно, че съдиите в СГС, на които имал доверие и предложил поста, не се съгласили да се натоварят с административни функции. Двете съдийки от СРС, които досега бяха и.ф. зам.-председатели на двете най-проблемни отделения в градския съд, свършили огромна по обем работа, за да нормализират ситуацията в отделенията. И това – въпреки „мръсната медийна кампания“ срещу ръководството на съда и „балонът“, надут в социалните мрежи от „четирима-петима“ съдии, членове на един от съдийските съюзи, обясни Топалов. По думите му съдиите от СГС вероятно отказвали да се натоварят с административна отговорност заради „фактическата непривлекателност“ на поста зам.-председател.
Освен това, обясни Топалов, в началото на май се провели две Общи събрания на съдиите от Търговско и Гражданско отделение, на което той призовал колегите си да изразят становища по въпроса за зам.-председателите или да направят предложения кой е подходящ за заместник на съответното отделение. Такива обаче не постъпили „дори и след като огромна по обем работа бе свършена“.
Галина Карагьозова и Юлия Ковачева се поинтересуваха на колко съдии от СГС е предложил зам.-председателския пост и положил ли е всички необходими усилия да излъчи зам.-председателска кандидатура от съда. Председателят на СГС обясни, че е разговарял със седем съдии от съда, но всички му отказали. „Да, абсолютно съм съгласен, че е най-добре ръководният екип да е вътрешен за органа на съдебната власт. От друга страна обаче е важно да бъде свършена работата“, посочи той и обясни, че той бил развяван като Самарското знаме по медиите, а това демотивира останалите съдии да поемат отговорност. „Да, според мен, съм направил всичко възможно. Всеки си изгражда зона на комфорт, от която не иска да излиза. Взел съм своето решение. Тези предложения не съм ги направил веднага, както някои колеги председатели“, поясни Топалов.
Димитър Узунов засипа председателя на СГС с въпроси – поинтересува се как е установил кои съдии пишат в социалните мрежи и от коя организация са и получи отговор: „В разговор с колеги“. Попита и дали след като нито един съдия не пожелал поста е предложил на командированите в СГС съдии. Топалов го упрекна, че не го цитира правилно и пак поясни, че не е предлагам на всички съдии от СГС, а само на тези, на които има доверие, че могат да следват концепцията му за управление на съда. Узунов пак взе думата, за да попита защо предложението за заместници предшества проведеното общо събрание и дали Топалов не счита, че трябва да го оттегли с оглед на предстоящите изменения в Закона за съдебната власт (в който се регламентира, че заместниците трябва да са органа на съдебната власт или в краен случай – магистрати от горно ниво). Калоян Топалов заяви, че неговото становище е, че ръководният екип трябва да носи отговорност за управлението на съда и в този смисъл председателят е този, който трябва да избере заместниците си.
Последва оживена дискусия, от която стана ясно, че част от членовете на съдийската колегия са се подготвили предварително да атакуват двете предложени съдийки. Димитър Узунов например цитира номера на три граждански дела на съдия Балинова, които, по думите му, били „неизложени“ (вероятно имайки предвид неизписани – б.а.) в срок. Затова предложи ВСС отново да отложи точката, за да изиска справка от СРС за делата на двете съдийки. Такава проверка обаче нито е сред законовите изисквания при избор на заместници, нито пък ВСС до този момент е правил подобни усилия в други случаи, в които част от кадровиците са възразявали, че председатели на съдилища немотивирано предлагат свои заместници от долни нива.
На предложението за отлагане на точката остро възрази Юлия Ковачева, като припомни, че ВСС вече два пъти отлага решаването на въпроса и саркастично отбеляза, че очевидно Димитър Узунов е подготвен с информация за забавените дела на съдийките. „Подобна информация не сме изисквали никога, по никакъв повод. Основавали сме се само на публична информация. Ако целта е да се дискредитират колегите, изписването на делата носи друг вид отговорност“, мотивира се тя, а тезата й бе подкрепена от Камен Иванов и Калин Калпакчиев.
Оказа се, че и друг член на съдийската колегия си е направил справка за делата на съдийките. Мария Кузманова обясни, че преди заседанието на ВСС говорила с деловодството на СРС и установила, че съдия Балинова има три неизписани дела. „Няма да се въздържа, но няма да участвам в гласуването“, каза Кузманова.
„Очевидно се изнервихте, г-н Калпакчиев, но срочността по дела е част от изискванията към магистрата”, обърна се Узунов към Калин Калпакчиев. Той пък му отвърна, че очевидно има „целенасочен интерес“ и явно Димитър Узунов „прави собствени проучвания“. Призова го в кръга на шегата да си изписва дисциплинарните дела в срок. „Ситуацията в тези две отделения предполага промяна изисква от нас да се доверим на Калоян Топалов“, каза Калпакчиев и допълни, че по време на дискусията някои от членовете на ВСС спекулират, че съдиите от СГС си мълчали от страх да изразят открито позиция. „Призовавам всички останали да си кажат честно къде ги стяга чепикът. И да кажат кое е правилното решение. Това е първият път, в който изслушваме председател по предложение за зам.-председатели“, категоричен бе Калпакчиев. После припомни, че ВСС безкритично е назначил външни заместници за Апелативен съд Варна, Апелативен съд Пловдив и Апелативен съд Велико Търново. „Защо това се случи аз не разбрах, защото нямаше аргументи кое го налагаше“, подчерта той и допълни, че е необходимо да се прави преценка при всеки отделен случай, а в конкретния – ситуацията в съда е извънредна, двете отделения имат много проблеми, заварени от старото ръководство, а възраженията срещу назначаването на външни зам.-председатели не са били самоцелни, а в посока, че са необходими мотиви какво налага такова решение.
Димитър Узунов обаче държеше на своето – предстояла законова промяна и ВСС би следвало да се съобрази с нея. Изрази и съмнения, че Топалов следи кой какво пише по форумите и попита колегите си дали смятат, че ще изразят свободно мнение на общото събрание и пак каза, че ВСС следва да провери дали съдийките имат забавени дела.
Итова му възрази – двете съдийки са добри професионалисти и заслужават да бъдат избрани, още повече, че били класирани в конкурса за съдии в СГС.
Светла Петкова, която до този момент винаги е подкрепяла решенията на мнозинството за избор на външни за органа на съдебната власт ръководители, призова да се следва практиката на съвета, но не и в този случай. „Какво виждаме сега пред нас? Предлагат ни се две кандидатки от СРС, командировани и то командировани не за да помагат на работата, а само, за да бъдат назначени за зам.-председатели. Защо от толкова много районни съдии, защо точно на тях се спряхме? Може да са много добри, но какъв е критерият тук? Тука с нищо не се показва, че командироването се е променило. Не се вижда никакво становище за подкрепа на съдиите от Общото събрание. Как пък от този съд не се намериха други желаещи?“, изказа се Петкова. После предположи, че разковничето на противопоставянето на съдиите в СГС било именно предложението на Топалов за заместници.
„Спорът винаги се е състоял в един единствен въпрос – да се изложат мотиви, когато се предлагат външни кандидати“, поясни и Юлия Ковачева и каза, че Топалов подробно е изложил мотиви за решението си.
„Изправени сме пред много труден избор. В конкретния случай нямам нищо лично срещу тях. Тука се изложиха едни факти, ако вземем решение сега – няма да сме ги проверили. Нека да отложим избора. Прави ми впечатление, че не всички съдии от колегията са участвали в Общото събрание. Ние трябва да му помогнем, но за да му помогнем трябва да сложим край на този дебат, да отложим точката, ще можем да съберем достатъчно доказателства за професионалните и управленските им качества“, предложи Георгиева и поиска ВСС да поиска справка от СРС за делата на двете съдийки, защото без тази информация тя не можела да оформи личното си становище, а имала желание ВСС да избере „най-подходящите хора“.
Галина Карагьозова заяви, че кадровиците са принизили дебата. „За мен е недопустимо юристи с високи професионални качества да се позовават на законови текстове, които не са приети и дори не са внесени в парламента“, каза тя и допълни, че ако сега ВСС отложи точката очевидната цел ще е да се възпрепятства работата на двете отделения от СГС. „Казва се, че градският съд е най-проблемен, градският съд беше най-проблемният съд и според мен това е разковничето защо упорито отказваме да назначим заместници на административния ръководител.
В крайна сметка двете съдийки бяха назначени за заместници на председателя на СГС. Балинова бе назначена с 8 гласа “за” и 5 “против”, а Данаилова – с 9 гласа “за” и 4 “против”.
