ВСС премина границата на кадровия абсурд – назначи председателя на Окръжния съд във Велико Търново за заместник-председател на Апелативния съд в града
До нови висини на кадровите абсурди достигна днес Висшият съдебен съвет (ВСС), след като избра председателя на Окръжния съд във Велико Търново Мая Маркова за заместник-председател на Апелативния съд в града и ръководител на Наказателната колегия. Предложението бе на прясно избрания председател на Апелативния съд Янко Янев. С решението си днес ВСС създаде прецедент.
Янев оглави Апелативния съд във Велико Търново през май миналата година, като до този момент бе съдия в Окръжния съд. Заедно с него за поста кандидатстваше съдията от Апелативния съд Галя Маринова, която бе подкрепена от председателя на Върховния касацинен съд Лозан Панов. Мнозинството в съвета обаче бламира Панов и избра Янев, зад когото застанаха председателят на ВАС Георги Колев и главният прокурор Сотир Цацаров, въпреки че в биографията на съдия Янев имаше спорни моменти.
Месец по-рано – през март 2015 г. ВСС преизбра Мая Маркова за втори мандат като председател на Окръжния съд във Велико Търново. Именно фактът, че съдия Маркова е спечелила доверието на кадровиците да ръководи съда, според концепцията, която е защитила, за мандат от пет години, предизвика възраженията на Калин Калпакчиев и Юлия Ковачева. Двамата не за първи път поставят въпроса, че заместниците на административните ръководители би следвало да се избират измежду съдиите от конкретния съд, а „качването“ на съдии от по-долни инстанции на ръководни позиции в горните съдилища създава съдебна номенклатура.
По този повод Галя Георгиева обясни, че председателят на Апелативния съд Янко Янев бил съгласувал назначението със съдиите. И допълни: „Мислих да не го казвам, но в Наказателната колегия има четирима съдии, ние наказахме двама от тях, третият бе пенсиониран“, поясни Георгиева.
Магдалена Лазарова каза, че ще подкрепи кандидатурата на съдия Маркова и не виждала пречка във факта, че тя е избрана за втори мандат начело на Окръжния съд. „Ще разкрия пред вас някои „тайни“, започна тя и допълни, че съдия Янев бил изслушан в Комисията по предложенията и атестирането и споделил, че среща трудности да намери свои заместник сред съдиите от Апелативния съд. „Толкова време го държим без екип“, каза Лазарова. Репликира я Калин Калпакчиев: „Ние Софийският апелативен съд го държим толкова време без председател“.
Соня Найденова пък припомни, че няма и година откакто съдия Маркова е била преизбрана за председател на Окръжния съд и е поела морален ангажимент към съвета да изпълни концепцията си. По думите й няма и година, след като тя „мигрирала“ в Апелативния съд. Найденова обясни, че със сигурност там има и други съдии, които биха могли да бъдат зам.-председатели.
Изказването на Найденова провокира остра реакция на главния прокурор Сотир Цацаров, който изтълкува изказванията на Ковачева, Калпакчиев и Найденова превратно. Той натърти, че съдия Мая Маркова е човек, който може да се справи с всякакви професионални и лични предизвикателства. „Ако имаше повече хора като нея в съдебната система, нямаше да сме там, където сме сега“, посочи той. Цацаров се скара на Найденова, че говори за „мигриране“. „Тя (Мая Маркова – б.а.) не мигрира. Тя работи и работи много често. Вие може да мигрирате, г-жо Найденова. Не се упражнявайте над името на Мая Маркова или мигрирайте, г-н Калпакчиев“, каза главният прокурор.
Репликира му Юлия Ковачева, която обясни, че изобщо не се упражнява над името на Маркова, а говори по принципни въпроси. „Избрахме човек, който не е от този съд, игнорирахме кандидатурата на съдия от този съд, вие си спомняте по какви причини“, подчерта Ковачева. Забележката й бе насочена към избора на председателя на Апелативния съд, когато Цацаров буквално се разкрещя на Галя Карагьозова заради опита й да постави въпроса за моралните качества на Янев.
Както „Съдебни репортажи“ писа, Карагьозова обърна внимание на етичното поведение на Янев като председател на Районния съд в Дряново. Като председател на Дряновския съд Янев е преназначил на длъжност съдебен архивар жената, с която живее на семейни начала – Наташа Христова, в съда, тя се издигнала до административен секретар и участвала в атестирането на сестра си (също назначена в администрацията на съда) и я предложила за допълнително материално стимулиране. Докладът на Карагьозова предизвиква светкавична ответна реакция на главния прокурор Сотир Цацаров, който буквално й се разкрещява и я обвинява в опит за дисквалифициране на един от кандидатите. “Дотук ли стигнахме г-жо Карагьозова? Айде да стигнем до данъчните му оценки. Нямам никакво съмнение в подхода ви към хората и в подхода ви на тази маса”, коментира Цацаров без да засегне основния въпрос за етичните качества на съдия Янев, който е избран с 14 гласа за председател на Апелативния съд във Велико Търново.
Същият израз използва и днес главният прокурор. „Ровихте в чаршафите!“, обърна се той към Ковачева. „Попитах защо няма човек от този съд, който да бъде назначен за зам.-председател. Може би за това трябва да говорим, въпросът е защо в този съд няма кандидати за тази длъжност“, попита тя, имайки предвид, че съветът игнорира кандидатурата на съдия от съда, за сметка на фаворита на Цацаров и Колев, който бе външен за Апелативния съд.
“Мигрирането е упражнение, не казаното от вас”, уточни пак главният прокурор. В опит да обясни странното решение на Янев Магдалена Лазарова всъщност назова проблемът – Янев не можел да намери свой заместник сред съдиите в Апелативния съд, защото всички му отказали.
Второто изказване на Соня Найденова пък бе прекъснато от Цацаров с предложението да се прекрати дебата. Думите му насърчиха Галя Георгиева, която стигна по-далеч – предложи ВСС да ограничи изказванията по една и съща точка до два пъти, защото „г-жа Найденова взима думата вече четири пъти“. Това провокира Галя Карагьозова остро да възрази срещу опита за цензура, която посочи, че докато има заявки за изказвания, не може да се прекратят дебатите, защото това е „недемократично“. „Тъкмо от госпожа Георгиева си спомням едно изключително пламенно изказване, че е обида към състава на съда да се избират заместници извън него. Така че аз няма да го коментирам повече“, припомни двойните стандарти на съвета Карагьозова.
В крайна сметка със 16 гласа за, един против и четирима въздържали се, ВСС повиши съдия Маркова до заместник на административния ръководител на Апелативния съд, като така оваканти председателското място в Окръжния съд във Велико Търново.
