Делото срещу Симеон Дянков, Трайчо Трайков и Иво Прокопиев не тръгна

Делото срещу бившия министър на икономиката и енергетиката Трайчо Трайков, бившия вицепремиер и финансов министър Симен Дянков и съиздателя на “Капитал” и “Дневник” Иво Прокопиев бе отложено днес от специализирания наказателен съд.
Тримата бяха обвинени зaради пpoдaжбaтa нa дъpжaвния дял нa EBH пpeз 2011 г. По делото има и още трима обвиняеми – изпълнителният директор на “Булброкърс” Радослав Рачев и служителите в компанията Петър Василев и Любомир Евстатиев.
Досъдебното производство датира от 2014 г., като първоначално обвинителният акт бе внесен в Софийския градски съд, откъде го върнаха на прокуратурата заради съществени процесуални нарушения. След измененията в НПК, които пратиха процесите за корупция в спецсъда, делото беше внесело там.
Причина за отлагане на процеса днес бе, че един от обвиняемите – Любомир Евстатиев не е получил обвинителния акт в законовия 7-дневен срок. Прокопиев, Василев и Евстатиев се явиха на заседанието без адвокати. Отсъствието на адвоката на Иво Прокопиев – Даниела Доковска накара представителите на прокуратурата Дойчо Тарев и Емил Петров (брат на бившия шеф на столичното следствие Петьо Петров – Пепи Еврото) да поискат назначаване на резервни защитници, за да не се забавя процеса.
Адвокат Ина Лулчева (която защитава Трайков) обясни, че Доковска е в чужбина, на планирано още от миналата пролет пътуване, като е заминала в средата на декември. И по-точно – в Америка, където от години живее сестрата на защитничката, и това е единственото време, в което двете могат да се видят. Лулчева допълни, че това е практика от 20 години.
Позовавайки се на последните промени в НПК прокуратурата изрази становище, че отсъствието на адвокат Доковска не е причина за отлагане на заседанието, а Прокопиев е трябвало да организира защитата си.
Адвокат Йорданка Вандова (която защитава Рачев) заяви, цитирана от “Дневник”, че издателят на “Дневник” и “Капитал” не е имал необходимото време, тъй като за насрочването на делото се е разбрало едва в началото на януари. Отсъствието на адвоката му е по уважителни причини, добави тя.
Защитниците се обединиха около становището, че делото трябва да се отложи заради това, че Евстатиев не е получил обвинителния акт в законовия срок, както и че няма основания за назначаване на резервни защитници. Адвокат Лулчева посочи, че искането на прокуратурата е обидно към защитата и почива само на предположения.
Следващият опит делото да тръгне е в началото на март.
Пред медиите адвокат Лулчева коментира, че нововъведеното разпоредително заседание не ускорява, а забавя делатата, а резултатът от законовите промени е, че сега виновен ще е съдът. “Убедена съм, че ще се положат всички усилия да е един справедлив, а от наша страна ще положим усилия да е и бърз процес, защото никой от тях няма интерес от това да се бави. Нямаме и съмнение за това, че няма извършено престъпление – това е категорично”, поясни адвокатката на Трайков.
